New Delhi : In a landmark order safeguarding both religious sanctity and statutory governance, the Hon’ble Delhi High Court, under the bench of Justice Sachin Datta, has issued clear directions in W.P.(C) 15916/2025 — Syed Meharaj Miya vs. Union of India & Ors.
The Court directed the Union of India, Ministry of Minority Affairs, to constitute new Dargah Khwaja Saheb Committee within three months and to fill all vacancies as required under the Dargah Khwaja Saheb Act, 1955. The Court observed that the tenure of the previous Dargah Committee expired in 2022, and no new committee has been constituted for nearly three years, contrary to the provisions of the Act.
Addressing the petitioner’s concern regarding privacy and sanctity of Astana Sharif (Sanctum Sanctorum) situated under the main dome of Sufi Saint Khwaja Syed Moinuddin Chishti in Ajmer Dargah Sharif.
The Court categorically clarified that:
“CCTV cameras will not be installed inside the sanctum sanctorum (Astana Sharif) and will cover only the public approach areas”.
This clarification upholds the spiritual integrity and privacy of devotees visiting the sacred Dargah Ajmer Sharif, ensuring that religious sanctity remains undisturbed.
The petitioner also urged the court to direct the Centre to appoint the dargah management committee, alleging financial irregularities in the current administration & other several concerns related to ajmer dargah misadministration.
The petition was argued by Mr. Shadan Farasat, Senior Advocate, with Mr. Chayan Sarkar, Advocate-on-Record, Ms. Arshnit Sandhu, and Mr. Shailender Kumar, Advocates on behalf of the Petitioner- Mr. Syed Meharaj Miya.
Statement from Syed Meharaj Miya:
“The Hon’ble Delhi High Court’s directions reaffirm the spiritual sanctity of the Astana Sharif and ensure lawful administration under the Dargah Khwaja Saheb Act. This decision safeguards the sacred space of devotees and restores faith in the due process of law.”
